Denmark: Update on the Danish Medicinal Cannabis Programme

Since the latest update from us in September 2019, there have been no legislative changes within the jurisdiction. However, there has been a great deal of debate about the four-year medicinal cannabis pilot programme, which was introduced in Denmark in 2018.

United States: Proposed Washington Cannabis Bills 2020, Part 2

The bills include two bills that would effectively remove Washington residency requirements and allow for significant out-of-state finance, one that would create an agricultural commodity commission, another that would allow persons 21 and over to grow up to six marijuana plants in their homes, and one that would codify the emergency rule enacted late last year defining “characterizing flavor” of marijuana vapor products.

United States: Washington Court Rules Prohibition on Retail Cannabis Businesses Within 1000-Feet of a School is Measured from a Leased Line or Lot Line

The Washington State Liquor and Cannabis Board regulations for issuing retail cannabis licenses prohibit, among other things, a retail cannabis business within 1000 feet of the “perimeter of the grounds” of a school. In Top Cat Enterprises, LLC v. City of Arlington, a retail cannabis license recipient sought to move from Marysville, which had just passed a ban on marijuana retailers, to Arlington, where only one retail license was available.

United States: USDA Issues Interim Final Rule on Hemp Production

The United States Department of Agriculture has issued interim final regulations for the production of hemp under the Agriculture Improvement Act of 2018 (the 2018 Farm Bill). The 2018 Farm Bill requires the USDA to promulgate regulations and guidelines to establish and administer the program for the production of hemp.

United States: Federal Agencies Issue Joint Statement Clarifying Hemp Banking Status

On December 3, 2019, the Board of Governors of the Federal Reserve System, the Federal Deposit Insurance Corporation, the Financial Crimes Enforcement Network, the Office of the Comptroller of the Currency, and the Conference of State Bank Supervisors released a joint statement on “Providing Financial Services to Customers Engaged in Hemp-Related Businesses.” The statement clarifies the legal status of hemp and hemp production, and certain requirements under the Bank Secrecy Act and its implementing regulations for banks providing financial services to hemp-related businesses.
